King City Gardens (“we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit our website at kingcitygardens.com or communicate with us through it (collectively, the “Services”). We are a licensed cannabis cultivator; we do not sell products through this website. Please read this policy carefully. By using our Services, you consent to the practices described below.

1. Information We Collect

  • Communications you send to us, including inquiries and feedback

1.2 Information Collected Automatically

1.3 Information from Third Parties

  • Message metadata from our live-chat provider (Intercom) when you choose to chat with us
  • Publicly available business information when you contact us on behalf of a company

2. How We Use Your Information

  • To verify you are of legal age to view cannabis-related content
  • To respond to your inquiries and communicate with you
  • To process employment applications
  • To operate, maintain, and improve our website
  • To comply with applicable state and local cannabis regulations
  • To detect, prevent, and investigate fraud, security incidents, or other illegal activity
  • To respond to legal requests, enforce our policies, and protect our rights

3. How We Share Your Information

We do not sell your personal information for money. Our live-chat widget involves sharing information with our chat provider, which may be considered a “sale” or “sharing” of personal information under some state privacy laws; you can opt out at any time using the “Do Not Sell or Share My Personal Information” link in the footer of every page. We may share your information in the following circumstances:

3.1 Service Providers

We engage trusted third-party vendors to assist in operating our business (e.g., website hosting, the live-chat widget, and email platforms). These providers are authorized to use your information only as necessary to provide services to us and are bound by confidentiality obligations.

3.2 Legal and Regulatory Compliance

As a licensed cannabis cultivator, we may be required to provide certain records to state and local regulatory agencies. We may also disclose your information in response to a subpoena, court order, government inquiry, or other legal process, or where we believe disclosure is necessary to protect our legal rights, ensure safety, or comply with applicable law.

3.3 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred to the acquiring entity, subject to the protections of this Privacy Policy.

3.4 With Your Consent

We may share your information with other third parties when you have given us explicit consent to do so.

4. Cannabis-Specific Privacy Considerations

We understand that cannabis-related information is particularly sensitive. This website does not process product orders or purchases, and we do not collect purchase histories or medical cannabis patient information through it. Purchases of our products take place at licensed dispensaries, which operate under their own privacy policies. We do not share information about your interest in cannabis products with employers, insurance companies, or federal agencies unless legally compelled, and we train our staff on maintaining the confidentiality of the information we do hold.

5. Cookies & Tracking Technologies

When you first visit our website, a cookie consent banner lets you accept all cookies, reject all non-essential cookies, or customize your choices by category. Non-essential cookies and tracking scripts are blocked and load only after you opt in. We keep a log of the consent choices you make so we can honor and evidence them, and you can change or withdraw your consent at any time using the “Do Not Sell or Share My Personal Information” link in the footer of every page. The categories of cookies we use are:

  • Strictly Necessary: required for the website to function and stay secure — the website platform (WordPress / Elementor), the cookie consent tool, the age verification gate, Google reCAPTCHA spam protection and the embedded Google reviews widget (Trustindex). Always active.
  • Functional: the Intercom live-chat widget, so you can message us directly from the website. It loads only after you opt in, and is covered by the “Do Not Sell or Share My Personal Information” opt-out.

We also honor the Global Privacy Control (GPC) browser signal as a valid request to opt out of the sale or sharing of personal information. Rejecting or withdrawing consent does not affect the lawfulness of processing carried out before withdrawal; strictly necessary cookies remain active because the website cannot function without them.

6. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we securely delete or anonymize it.

7. Your Privacy Rights & Choices

Depending on your state of residence, you may have the right to access, correct, or delete the personal information we hold about you; to opt out of marketing communications; to request a portable copy of your data; and to restrict certain processing. To exercise any of these rights, please contact us using the information in Section 11. We will respond within a reasonable timeframe and in accordance with applicable law, and we may need to verify your identity before fulfilling your request.

8. Children’s Privacy

Our Services are intended solely for individuals who are of legal age to view cannabis-related content in their jurisdiction (21 years or older). We do not knowingly collect personal information from minors. If we become aware that we have inadvertently collected information from an individual under the applicable legal age, we will take immediate steps to delete that information.

9. Data Security

We implement technical, administrative, and physical safeguards designed to protect your personal information against unauthorized access, loss, misuse, alteration, or destruction, including SSL/TLS encryption for data transmitted through our website. Despite these measures, no system is completely secure; please notify us immediately if you suspect unauthorized access to your information.

10. Third-Party Links & Changes to This Policy

Our website contains links to third-party websites and services, including the online menus of licensed dispensaries that carry our products. This Privacy Policy does not apply to those third-party services, and we encourage you to review their privacy policies. We reserve the right to update or modify this Privacy Policy at any time; when we make material changes, we will update the “Effective Date” at the top of this page and, where appropriate, notify you with a prominent notice on our website.
